Serving Notice Period in India: A Practical Exit Guide

Plan your notice period, confirm your last working day, request an early release and organise a clear handover without assuming one rule fits every job.

Serving a notice period means working through the agreed interval between giving notice and the end of your employment, unless a different arrangement is confirmed. The useful starting point is your appointment letter, relevant policies and the law that applies to your employment. A colleague's thirty-day exit does not establish your own last working day.

This guide helps you organise the practical steps. It does not determine whether a disputed clause is enforceable. Notice, leave, deductions and termination can involve different rules depending on the establishment, state, role and circumstances. Get qualified advice for a disputed exit rather than treating an online calculator as a legal decision.

Confirm the rule before calculating the date

Find the clause that applies to resignation, not just the paragraph about termination by the employer. Check whether probation has a separate rule, whether the period is stated in days or months, and whether your contract describes a payment alternative. Save the version of the policy that HR says applies. A verbal statement that the company always follows ninety days is less useful than an identified clause and written date confirmation.

Ask HR which date starts the count and whether the count uses calendar days. A calendar month is not always thirty days. Weekends do not automatically disappear from a notice calculation. Leave does not automatically reduce it either. Enter the agreed assumptions in the notice period calculator, then ask HR to confirm the result. The calculation is a planning aid, not approval to leave.

Send a resignation that is easy to act on

Use a short message that gives the date, the role and your proposed last working day. You can keep your reasons private or state them briefly. You do not need a long account of everything that went wrong. Send it through the channel your organisation requires and keep a copy you are allowed to retain.

Illustrative resignation email: Dear Meera, I am resigning from my position as Operations Associate. I am submitting notice on 7 September 2026. Based on my understanding of the notice clause, my proposed last working day is 6 November 2026. Please confirm the applicable date and the handover process. I will prepare a list of current work, owners and outstanding decisions this week. Thank you for the opportunity to work with the team. Regards, Ananya.

Ananya, Meera and the situation above are fictional. The dates illustrate a sixty-day count beginning the day after submission. Use your own confirmed counting convention. If acceptance, receipt or another event is relevant under your arrangement, resolve that question before promising a joining date elsewhere.

Request an early release with a workable proposal

Separate the request from the assumption. Explain the earlier date you are seeking and what can be completed before then. Offer a practical handover rather than an open-ended promise to work two jobs. If payment in place of unserved notice is being discussed, ask who would pay whom, which days are included and how the amount is calculated.

A useful request reads: Could we agree an earlier last working day of 23 October? I can complete the monthly reconciliation by 16 October, document the exceptions and run two handover sessions with the new owner. Please confirm whether this is possible and whether any notice payment would apply. I will retain the existing agreed date until a change is confirmed.

A notice buyout is not a universal right that a new employer can activate merely by offering money. Whether it is available and how it works needs checking against the applicable terms and law. Ask payroll to explain the payment basis and confirm the unserved days before accepting a calculation.

Build a handover someone can actually use

For each piece of work, record its current state, next action, deadline, owner and the location of approved records. Put unresolved decisions in a separate list so they do not disappear inside a long document. Include access requests the replacement will need, but never share your password or copy confidential files to a personal account.

For example: Vendor reconciliation, August invoices; six exceptions remain; finance lead to approve two credit notes by Friday; working file stored in the team finance folder; incoming owner is Kavya. That is more useful than writing that all finance work has been handed over. Ask the receiving person to confirm what they have received and what remains open.

Discuss leave and joining dates explicitly

If you need leave during notice, request approval through the normal channel and ask whether it changes the last working day. Do not assume unused leave can be exchanged for fewer notice days. Leave approval, leave encashment and notice waiver are separate questions, even when they appear in the same final settlement.

Tell a prospective employer what you know: I am serving notice and my confirmed last working day is 6 November. I have requested an earlier release, but it is not yet approved. This is clearer than describing yourself as an immediate joiner while your exit date is unresolved. Keep your availability consistent across recruiter messages and application forms.

Check settlement and documents separately

Ask for an itemised statement covering earned wages, approved reimbursements, leave treatment and any proposed deductions. Request the expected dates for the statement, payment and employment documents. A single label such as full and final can hide items with different legal treatment. Raise discrepancies in writing with the calculation and supporting records.

The government announced that the four Labour Codes became effective on 21 November 2025. Do not rely on older articles that say the Codes have not commenced. Commencement does not establish one resignation notice period for every employee. Read the government announcement.

Section 17 of the official Labour Ministry handbook on the Code on Wages addresses the timing of wages payable on resignation and other exits. That provision should not be casually restated as a promise that every component of every final settlement arrives within the same deadline. Ask a qualified adviser about the applicable provisions if wages or deductions are disputed.

Your final-week checklist

Confirm the last working day in writing, finish the agreed handover, return equipment against a receipt, submit legitimate expenses and check your personal contact details for employment documents. Keep only records you are entitled to retain. Before accepting another joining date, make sure the exit arrangement and any unresolved obligations are understood by the people who need to know.
